I, hereafter “Releasing Party” am voluntarily and of my own accord, participating in the exercise, fitness and health programs conducted by ECSlifestyle Corp, hereafter along with other listed parties, sometimes referred to as “Released Party” or “Released Parties.”  I recognize that the programs requires physical exertion that may be strenuous at times and may cause physical injury and I am fully aware of the risks and hazards involved.

 

I understand that it is my responsibility to consult with a physician prior to and regarding my participation in any exercise and fitness regimen, and specifically in regard to the above mentioned programs, and I have not relied upon the advice, medical or otherwise, of the Released Party, or any person or entity associated therewith, in influencing my decision to participate in the aforementioned exercise, fitness and health programs.  I represent and warrant that I have no medical condition that would prevent my participation in the programs.  I agree to assume full responsibility for any risks, injuries, or damage, known or unknown to me, which might incur as a result of participating in said programs. Such injuries may include, but are not limited to, heart attacks, stroke, muscle strain, muscle pulls, muscle tears, broken bones, shin splints, heat prostration, injuries to knees, dehydration, injuries to back, injuries to foot, or any other illness, injury, or soreness, including death, and this waiver shall include, but not be limited to, waiver of any injury or death resulting from the negligent acts of the Released Party or any person or entity associated therewith and to any premises liability.

 

I knowingly, voluntarily, and expressly waive any claim I may have against ECSlifestyle Corp, as well as any of its principals, members, stockholders, contractors, subcontractors, employees, or assigns, as well as any other person or entity operating, or participating in the operation of the exercise, fitness and health programs which is the subject of this agreement,  for any injury or damages, including the aforementioned injuries or damages, that I may sustain as a result of participating in the programs.

 

I, and my heirs or representatives, forever release, discharge and covenant not to sue ECSlifestyle Corp, as well as any of its principals, members, stockholders, contractors, subcontractors, employees, or assigns, as well as any other person or entity operating, or participating in the operation of the exercise, fitness and health programs which is the subject of this agreement,  for any injury or death caused by their negligence, premises liability, or other acts.

 

I have read the above waiver and release of liability and fully understand it contents. By registering to a class, program or training session I voluntarily agree to the terms stated above.
